The user agrees not to access or attempt to access tools, utilities, or functionalities through mechanisms or means other than the interface provided by any contracted application, unless expressly authorized by L3TCRAFT.

The user agrees to make diligent use of any access keys to restricted areas of the website, content, and services, being responsible for their security and confidentiality. The user has the obligation and exclusive responsibility to store and safeguard them in a safe place to prevent unauthorized access by third parties. Additionally, the user agrees to inform the entity as soon as possible of any incident that arises or may arise, posing a risk to the confidentiality of the data.

The user agrees not to engage in any activity that hinders or interferes with the functioning of the website, content, and associated services.

This clause specifies that the user agrees to comply with national and international anti-spam regulations. The user must not send any kind of advertising or commercial communication to a group of people without their prior request or consent. The user is also prohibited from sending unsolicited messages or chain emails to multiple recipients or using distribution lists obtained through the service for such purposes. L3TCRAFT will not be responsible and reserves the right to immediately interrupt the services if it becomes aware that the user is using or employing such content for activities considered illegal or for the transmission of content contrary to morality, public order or legal regulations, or that violate the right to Privacy or the Intellectual or Industrial Property Rights of third parties.

2.4. Access and use of contents. The user may access the contents, contents and services integrated into the web on the terms and conditions that accompany them, whether through visualization, remote access and use or, where appropriate, download, it being understood that the user will acquire a mere personal and limited right of use over them, authorizing exclusively the access and use of contents and services exclusively to the acquirer of the same for their strictly personal use to satisfy their own needs, taking into account the particular conditions governing their access and use. 2.5. The user is the sole owner or licensee or authorized holder of the information and content incorporated in their corporate and advertising material as well as the content stored, processed, managed and/or sent from this website or from the content and services marketed through it, which the user has access to, and is responsible for its truthfulness, timeliness, legality, and legitimacy. Therefore, in accordance with the provisions set forth in these terms and conditions, no liability may be attributed to L3TCRAFT for damages of any nature and kind that may arise from the use of the website and its utilities, tools, content and services, as well as the use, supply, communication and/or exploitation of content by the user or third parties.

2.6. The user is solely responsible to any third party for damages or harm directly or indirectly derived from the contents incorporated or generated by themselves, and shall undertake to take all necessary measures to keep L3TCRAFT free and safe from any claims or demands of any kind, including those related to Public Administrations regarding the operation or content of the messages transmitted.

2.7. Adding of links. The user also agrees to comply with any special warnings or usage instructions contained in them or on the website, and to always act in good faith and in accordance with the law, morality, and good customs, using the diligence appropriate to the nature of the service they enjoy, refraining from using the website, utilities or content in a way that could impede, hinder, damage or impair its normal operation, the image, assets, or rights of L3TCRAFT, partners, suppliers, customers, employees, or third parties.

3. Rights of intelectual and industrial property

3.1. The website, design, developments, computer programs, applications, "L3TCRAFT" software, technical documentation, user manuals, texts, images, trademarks and other distinctive signs, graphics, logos, and buttons that are integrated into it, as well as their graphic representation, structure, selection, arrangement, and presentation of their contents, audio, files, databases, and their own contents therein are protected by Spanish intellectual and industrial property laws, community regulations, and international treaties. All intellectual property rights are reserved for all of this. The user acknowledges and accepts that all industrial and intellectual property rights over the website, its contents, and/or any other elements included on the website and "L3TCRAFT" software (including, without limitation, trademarks, logos, trade names, other distinctive signs, texts, documents, methodologies, processes, procedures, images, graphics, icons, photographs, designs, sounds, databases, software, flowcharts, presentation, programming elements, web design, audio and video) belong to L3TCRAFT, its suppliers and/or third-party owners who have authorized their inclusion therein, except for those incorporated by the user lawfully and legitimately. Under no circumstances does access to the application imply any type of waiver, transmission, license, or total or partial assignment of such rights or expectation of rights, unless expressly stated otherwise.

3.2. These general terms and conditions of use of the web application do not confer on the user any other right to use the web and/or its tools, functionalities, contents, and associated services other than those expressly and formally recognized based on their requests. Any other use or exploitation of any rights shall be subject to the prior and express authorization specifically granted for such purpose by L3TCRAFT.

3.3. L3TCRAFT may use “cookies” or similar files in any type of use of the web, in order to make the user's navigation and use of its options more comfortable and easy from their access device. However, the user will have information regarding cookies in a specific section of the web with updated information on them. The user accepts that L3TCRAFT or its service providers may use cookies when a user browses the web or uses any of its functionalities and options, such as contact. 5. Security

5.1. L3TCRAFT, aware of the risks involved in facing the new challenges posed by the provision of services or the use of applications or communication tools through communication networks, especially the Internet, has implemented demanding security measures to reduce such risks. However, L3TCRAFT cannot guarantee the absolute invulnerability of its security systems, and therefore excludes any liability for damages of any nature and kind that may be due to the presence of viruses or other elements that may produce alterations in the computer system (software and hardware), terminals, electronic documents, and files of the user or any third party.

5.2. The user is informed that the use of electronic data transmission systems, email, and sending messages to mobile devices through technological platforms does not offer absolute security guarantees. L3TCRAFT and the user mutually exempt each other from any liability arising from events such as non-receipt or delay of communications, errors, or interception of communications.

5.3. Access to the application and associated tools as well as any unauthorized use that may be made of the information and content thereof is the sole responsibility of the person carrying it out. L3TCRAFT shall not be held responsible for any consequences, damages or harm that may arise from such access or use.

 

6. Guarantee and responsibility exclusion

6.1. Exclusion of guarantees and liability for the operation of the website and requested information services. L3TCRAFT does not guarantee the availability and continuity of the website's operation, its contents, or those of other websites with which a link has been established. Likewise, L3TCRAFT will not be responsible for any damages that may arise, merely enunciative and not limiting, due to: a) The lack of availability or accessibility to the website and its contents or to those other sites with which a link has been established; b) Interruptions in the operation of the website or computer failures, telephone breakdowns, disconnections, delays, or blockages caused by deficiencies or overloads in telephone lines, the Internet system, or other electronic systems produced during its operation; c) The unsuitability of the website for the specific needs of users; d) Other damages that may be caused by third parties through inferences or unauthorized intrusions beyond the control of L3TCRAFT; e) The impossibility of providing the service or allowing access and use due to reasons not attributable to L3TCRAFT, attributable to the user, third parties, or force majeure; and f) The lack of permanent updating of its contents and the divergences of information, documentation, and contents of the website, its appearance, graphical representation, and visualization with the printed version.

L3TCRAFT implements various protection measures to safeguard the website and its contents against unauthorized third-party cyber attacks. However, L3TCRAFT does not guarantee that unauthorized third parties will not gain access to the user's use of the website or the conditions, characteristics, and circumstances in which such use is carried out. Therefore, L3TCRAFT will not be liable in any way for any damages that may result from such unauthorized access.

L3TCRAFT shall not be responsible for the improper functioning of the system if it is due to maintenance work on it, incidents affecting international operators, system overload not attributable to L3TCRAFT, inadequate configuration of the user's equipment, or insufficient capacity to support the essential computer systems needed to use the service. L3TCRAFT shall also not be liable for failures and/or damages resulting from the incompatibility of the services with other software or computer programs with which they are not specifically interoperable.

L3TCRAFT is not responsible for failures that occur in communications and networks, and does not guarantee the availability and continuity of the operation of the application, associated tools, and services. Therefore, L3TCRAFT does not guarantee the absence of interruptions or errors in accessing the application, associated tools, their utilities, or their content, nor that all of it is continuously updated. L3TCRAFT will carry out, whenever it is within its competence and there are no causes that make it impossible or difficult to execute, and as soon as it becomes aware of errors, disconnections, or lack of updating, all those tasks aimed at correcting errors, restoring communication, and updating the tool.

6.2 Exclusion of warranties and liability for the use of the website, content, applications, and/or related services. L3TCRAFT does not generally monitor the use that users make of the website and its content and applications. L3TCRAFT does not guarantee nor will be responsible in any case for the use that users and/or third parties may make of the website, its content, applications, or related services, nor for the damages that may derive from it.

6.3 Exclusion of warranties and liability for content.  L3TCRAFT does not guarantee or assume responsibility for the suitability of each of the contents published on the website for specific user profiles of the website. L3TCRAFT does not edit third-party content published on the website and therefore does not guarantee or assume responsibility for the legality, reliability, usefulness, truthfulness, accuracy, completeness, and timeliness of such content. L3TCRAFT will not be responsible in any case for any damages that may arise from: a) The lack of legality, reliability, usefulness, truthfulness, accuracy, completeness, and/or timeliness of content originated by third parties; b) The inadequacy for any purpose and the disappointment of the expectations generated by the content; c) Decisions or actions taken or avoided by the user relying on the information or data provided in the content, including without limitation the loss of profits or business opportunities.

6.4 Exclusion of guarantees and liability in relation to links. The website provides users with technical link devices that allow them to access pages and/or websites belonging to and/or managed by third parties. L3TCRAFT checks the content existing on such pages at the time it establishes a link to them and does so in good faith belief that such content complies with applicable law. However, in no case does L3TCRAFT take responsibility for, approve, or endorse the products, services, content, information, data, files, and any kind of material existing on such websites, and it does not control, approve, or endorse successive modifications of such materials. In the event that it deems it appropriate or is required to do so by judicial or administrative order, L3TCRAFT will remove links to those websites that infringe applicable law and/or violate the rights of third parties.

6.5. L3TCRAFT shall not be liable for any damages of any nature or kind that may arise from the lack of availability or uninterrupted continuity of the service due to causes beyond its control, loss of expected profit or usefulness that L3TCRAFT or its users could have attributed to the utilities or services, or the fallibility of all of these. L3TCRAFT shall not be liable under any circumstances for any special or indirect damages, or for any other damages resulting in loss of use, data or profits, or in a legal action for breach of contract, negligence, or any other type, arising from or related to the use, performance or information available on the website.

8. Actions in case of infringement

L3TCRAFT reserves the right to take any actions available to it under the current and applicable law in each case to demand the responsibilities that may arise from the breach of any of the provisions of these general terms and conditions of use of the website and/or related services by a user.

9. Integrity

The declaration of any of these general access and use conditions as null, invalid, or ineffective shall not affect the validity or effectiveness of the remaining ones, which shall continue to be binding between the parties. Waiver by either party to enforce any of the general conditions stipulated herein at a given time shall not imply a general waiver of compliance with another condition or conditions, nor shall it create an acquired right for the other party.

10. Applicable law and competent jurisdiction

These general conditions of access and use of the website will be governed and interpreted in accordance with the laws of Spain. For the resolution of any controversy that may arise from the access and use of the website, the user and L3TCRAFT submit, with express waiver of any other jurisdiction that may correspond to them, to the Courts and Tribunals of the city of Madrid (Spain).

IMPORTANT: In case that contradictory or different information were to be found between the Spanish version of this policy and those who have been translated to other languages, the Spanish version will prevail over all others.
